Terms & Conditions of Sale

General terms of distance selling applicable to purchases made on this site. Please read them carefully before ordering: by confirming your order you accept them.

Seller and scope

This site is operated by Nausica Ferrandi, Italian VAT no. 04757370160, who sells the products offered directly (the “Seller”). Contact: info@nausicaferrandi.it.

These terms govern all distance sales contracts concluded through this site and apply both to consumers under Italian Legislative Decree 206/2005 (Consumer Code) and to business customers, with the differences set out below. By placing an order you confirm that you are of legal age, have legal capacity, and have read and accepted these terms in the version published at the time of the order.

The products

The products are swimwear handmade in Italy, often in limited runs. Because each piece is made by hand, slight differences in shade, print placement, finishing and fit compared with the published images are possible: these are not defects but the natural characteristic of a handmade product. Colours on screen also depend on your device settings.

Images and descriptions are illustrative; the essential characteristics stated on the product page at the time of the order prevail. Please check the size guide before buying and write to us if in doubt.

How the contract is concluded

The display of products on the site is an invitation to treat. The order submitted at checkout is a binding purchase offer by the customer. The contract is concluded when the Seller sends the order confirmation email to the address provided, summarising products, prices, shipping costs and these terms.

The Seller reserves the right not to accept orders that are incomplete, contain clearly untrue data, are suspected of fraud, come from customers with previous defaults, or cannot be fulfilled due to unavailability: in such cases you will be notified and fully refunded for any amount already charged, at no cost.

A copy of the order remains available in your account area; please keep the confirmation email.

Prices, VAT and invoicing

All prices are in Euro and include VAT where applicable. Shipping costs, any additional charges and the final total are always shown before you confirm the order.

The Seller may change prices at any time: the price published when the order is submitted applies. In the event of an obvious pricing error (for example an amount clearly disproportionate to the product's value) the Seller may cancel the order, informing the customer and refunding any sums paid in full.

An invoice is issued on request, using the tax details provided during checkout: the customer is responsible for their accuracy, and details cannot be changed once the document has been issued.

Payments

Payments are accepted through the methods shown at checkout: credit and debit cards, Apple Pay, Google Pay and PayPal via the secure Stripe and PayPal gateways, or bank transfer where available. Transactions run over an encrypted channel: full card details never pass through or get stored on the Seller's systems.

Payment is charged on order confirmation. For bank transfers the order is prepared only once funds are received and remains valid for 7 working days, after which it may be automatically cancelled and the items returned to stock. If payment is declined or reversed by the provider, the contract is automatically terminated.

Availability

Availability shown on the site is kept up to date but, given handmade production and multiple sales channels, is not an absolute guarantee of stock. If an item turns out to be unavailable after ordering, we will notify you promptly and offer an equivalent replacement, the option to wait for production, or a full refund of the amount paid, made within 14 days.

Shipping and delivery

We ship within Italy and internationally by express courier. Costs and estimated delivery times are shown at checkout before you confirm the order and in the confirmation email. Processing times start from receipt of payment and exclude public holidays and closure periods announced on the site.

Delivery times are indicative: delays caused by the courier, by force majeure or by incomplete or incorrect shipping details provided by the customer give no right to compensation, without prejudice to Art. 61 of the Italian Consumer Code, under which a consumer who does not receive the goods within the agreed period may set an additional period and, if it passes without delivery, terminate the contract and obtain a refund.

For shipments outside the EU, any customs duties, taxes and clearance fees are payable by the recipient and are not included in the price. Refusing a shipment at customs means storage and return costs will be charged.

On delivery, please check that the parcel is intact and note any reservation in writing on the courier's document if the packaging is damaged or tampered with. For consumers, the risk of loss or damage passes on physical delivery.

Right of withdrawal

Consumers may withdraw from the purchase without giving any reason within 14 days of physically receiving the products (or the last product of a multiple order), under Arts. 52 ff. of the Italian Consumer Code. Simply notify your decision within that period through the account area or by writing to info@nausicaferrandi.it, and return the products within the following 14 days.

Return costs: the cost of returning the goods is borne by the customer. The refund covers the price of the products and the cost of the original standard shipping, and is made within 14 days of the withdrawal notice using the same payment method; the Seller may withhold the refund until the goods are received or proof of dispatch is provided.

Hygiene exclusion: under Art. 59(1)(e) of the Italian Consumer Code, the right of withdrawal does not apply to sealed goods which are not suitable for return for hygiene reasons and which were unsealed after delivery. Swimwear must therefore be returned unworn, tried on over your own underwear only, with tags, an intact hygiene seal and original packaging. The customer is liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Size exchanges and store credit are commercial options offered in addition to, and not instead of, the statutory right of withdrawal: details are on the Returns, refunds and exchanges page.

Legal warranty of conformity

All products sold to consumers carry the 24-month legal warranty of conformity from delivery, under Arts. 128 ff. of the Italian Consumer Code. In case of a lack of conformity the consumer is entitled, free of charge, to have conformity restored by repair or replacement and, failing that, to a price reduction or termination of the contract.

Report the defect to info@nausicaferrandi.it with your order number and photographs. Normal wear, damage from improper use, failure to follow washing and care instructions, contact with chlorine, sun creams or rough and abrasive surfaces, and the natural variations of handmade production are not defects. Purchases by business customers are covered by Arts. 1490 ff. of the Italian Civil Code, with defects to be reported within 8 days of discovery.

Discount codes and vouchers

Promotional codes and vouchers are personal, non-transferable, cannot be combined unless stated otherwise, cannot be exchanged for cash and give no right to change. They are valid for the period stated on issue and may be cancelled in case of fraudulent use or cancellation of the related order. If an order is returned, the value of the voucher used is reissued as a new voucher of the same amount.

Account, use of the site and newsletter

Registration is optional and free. Customers must provide true and up-to-date information and keep their credentials safe, being responsible for all activity carried out with them. The Seller may suspend or close accounts used fraudulently, for unauthorised resale of the products, or in breach of these terms.

Using the site for unlawful purposes, automated scraping of content, and any activity that may compromise its operation or security is prohibited. Newsletter subscription is voluntary and can be cancelled at any time via the link at the bottom of each message.

Intellectual property

The brand, names, designs, prints, photographs, texts and all other content of the site belong to Nausica Ferrandi or are used under licence, and are protected by trademark and copyright law. Reproduction, modification, distribution, communication to the public and any commercial use, even partial, is prohibited without written authorisation. Purchasing a product transfers no intellectual property rights.

Liability

The Seller is liable for damage caused by its own fault within the limits set by law; nothing in these terms limits liability for wilful misconduct, gross negligence, personal injury, or the mandatory rights of consumers. The Seller is not liable for interruptions, malfunctions or temporary unavailability of the site due to maintenance, technical causes or force majeure (strikes, natural events, transport disruption, acts of authorities), nor for the content of third-party sites reachable through links.

Personal data

The processing of customers' personal data is described in our Privacy Policy, which forms an integral part of these terms.

Governing law, complaints and jurisdiction

These terms are governed by Italian law. Consumers retain the benefit of any more favourable mandatory provisions of the law of their country of habitual residence.

Complaints can be sent to info@nausicaferrandi.it: we aim to reply within a few working days and to find an amicable solution. Consumers may also turn to a competent alternative dispute resolution (ADR) body. For disputes with consumers, the courts of the consumer's place of residence or elected domicile have jurisdiction; for business customers, the Seller's forum has exclusive jurisdiction.

Changes

The Seller may update these terms at any time. The version published on this page when the order is submitted always applies, and we recommend saving or printing it. If any single clause is invalid, the remaining clauses stay in force.
